When a financial institution initiates recovery under the SARFAESI Act, they often bypass the court system to take direct possession of assets. Our practice is dedicated to invoking the jurisdiction of the Debt Recovery Tribunal (DRT), Dehradun, to stay these proceedings and protect the proprietary rights of borrowers and guarantors.
1. Challenging Section 13(2) & 13(4) Notices
The recovery process begins with statutory notices that must strictly adhere to the law. We identify procedural lapses to stall the recovery chain:
- Objections to Demand Notices: Drafting comprehensive legal objections to Section 13(2) notices, challenging the quantum of debt, interest calculations, or the validity of the underlying security.
- Contesting Possession Notices: Filing Securitization Applications (SA) under Section 17 of the SARFAESI Act to challenge the symbolic or physical possession of property under Section 13(4).
2. Stay on Auctions & Sale Notices
The most critical phase of a Securitization Application is preventing the irreversible sale of the asset.
- Urgent Interim Relief: Moving the DRT for immediate stay orders on public auctions or private treaty sales where the bank has failed to follow the mandatory valuation and notice rules.
- Setting Aside Illegal Sales: If an auction has already occurred, we litigate to have the sale set aside based on fraud, undervaluation, or non-compliance with the Security Interest Enforcement Rules.
3. Defense for Guarantors & Third Parties
- Guarantor Protection: Defending the personal assets of guarantors when the bank has failed to exhaust remedies against the principal borrower or the primary secured asset.
- Third-Party Claims: Representing bona fide purchasers or tenants whose rights are threatened by a bank’s recovery action against a landlord or previous owner.
4. NPA Classification Disputes
- Challenging NPA Status: We scrutinize bank records to identify premature or wrongful NPA classifications that violate RBI Master Circulars, seeking to nullify the entire recovery process at its root.
